Terms of service
Article 1: Preamble
These terms and conditions of sale are concluded between, on the one hand, the company CORICA SRL, whose registered office is located at Rue Marché aux Poulets 49, 1000 Brussels, registered with the Crossroads Bank for Enterprises under number 0443.680.968, hereinafter referred to as “the seller”, and, on the other hand, any natural or legal person wishing to make a purchase via the seller’s website, hereinafter referred to as “the buyer”.
Article 2: Purpose
These terms and conditions of sale are intended to define the contractual relationship between the seller and the buyer, as well as the conditions applicable to any purchase made through the seller’s website, whether the buyer is a professional or a private individual. The acquisition of a product or service through this site implies the buyer’s unconditional acceptance of these terms and conditions of sale. These terms shall prevail over any other general or specific conditions not expressly agreed upon by the seller. The seller reserves the right to modify its terms of sale at any time. In such a case, the applicable conditions shall be those in force at the date of the order by the buyer.
Article 3: Characteristics of the Goods Offered
The products offered are those listed in the catalogue published on the seller’s website. Each product is accompanied by a description provided by the supplier. The photographs in the catalogue are as accurate as possible but cannot guarantee perfect similarity with the product offered, particularly regarding colors. These products and services are offered subject to availability. If, despite efforts, all or part of the items are unavailable, the seller will inform the buyer by email as soon as possible and offer the option to wait or cancel the order for the unavailable items at no cost. Available items will be delivered as normal.
Article 4: Prices
The prices of products displayed on the website are indicated in euros, all taxes included (VAT and other applicable taxes). The seller reserves the right to modify its prices at any time. However, the prices applicable to the order are those in effect at the time of confirmation. Prices do not include order processing, transport, and delivery costs, provided these occur within the geographical areas defined below. Payment is made by Visa, Mastercard, or Maestro. Ordered items remain the exclusive property of the seller until full payment has been received.
Article 5: Geographical Areas
The online sale of products and services presented on the seller’s website is reserved for buyers residing in Belgium, France, Switzerland, the Grand Duchy of Luxembourg, Germany, Italy, Spain, Sweden, Denmark, Austria, Finland, Poland, Portugal, Ireland, Norway, the Netherlands, and the United Kingdom, for deliveries within these geographical areas.
Article 6: Orders
The buyer who wishes to purchase a product must:
- complete the identification form by providing all requested details or provide their customer number if they have one;
- complete the online order form with all references of the selected products or services;
- validate their order after checking it;
- make payment under the specified conditions;
- confirm the order and payment.
Confirmation of the order implies acceptance of these terms and conditions of sale, acknowledgment of full knowledge of them, and waiver of the right to rely on one’s own purchasing conditions or other conditions. All data provided and the recorded confirmation shall constitute proof of the transaction. Confirmation shall constitute signature and acceptance of the operations carried out. The seller will communicate confirmation of the registered order by email.
Article 7: Right of Withdrawal
In accordance with the law, a private buyer has the right to notify the seller that they withdraw from their purchase, without penalty and without stating a reason, within 14 working days from the day following delivery of the product or conclusion of the service contract. This right does not apply to professional buyers.
Within this period, the private buyer must notify their intention to withdraw by email to info@corica.be and return, at their own expense and risk, the delivered product to Corica SRL: Brusselsesteenweg 426-428, 3090 Overijse.
Products must be returned in their original packaging, undamaged, with all accessories, user manual, and original invoice/delivery note. The products must not have been opened, unsealed, or used in any way. Incomplete, damaged, or soiled goods will not be accepted.
Within 30 days after acceptance of the returned goods, the seller undertakes to refund any payment, excluding shipping costs.
The right of withdrawal does not apply to perishable goods sold online due to their nature and the impossibility for the seller to verify proper storage conditions after delivery.
In case of abusive returns, Corica SRL reserves the right to refuse future orders.
Article 8: Deliveries
Deliveries are made to the address indicated on the order form, within the agreed geographical area. Goods are transported at the seller’s risk until delivery to the address specified by the buyer. From that moment, the buyer assumes all risks.
Delivery times are given for information purposes only, but Corica SRL undertakes to deliver ordered items as quickly as possible. The average delivery time for available items is 2 days within Belgium. If delivery exceeds 30 days from the order date, the sales contract may be cancelled and the buyer refunded.
Article 9: Warranty
For private buyers, the seller guarantees the products it sells in accordance with the Belgian law of 1 September 2004 on consumer protection (Articles 1649bis to 1649octies of the Civil Code). In case of non-conformity observed within 2 months of delivery, the buyer must notify the seller immediately by registered letter.
This warranty covers only defects existing at the time of delivery. Damage due to misuse (water damage, oxidation, impact, negligence, wear, etc.) is not covered. Repairs by unauthorized technicians void the warranty.
The invoice or delivery note serves as proof of warranty and must be kept. If the product is used for non-private purposes, the manufacturer’s limited warranty applies.
Article 10: Liability
Corica SRL is bound by an obligation of means for all stages of website access, ordering, delivery, and subsequent services.
It cannot be held liable for damages related to internet use (service interruptions, intrusions, viruses, or force majeure events).
Products are delivered via standard postal services. Corica SRL declines responsibility for delivery delays, loss, or strikes related to transport services. Transport risks are borne by the buyer, who must file claims with the carrier.
Corica SRL shall not be liable for any material, immaterial, or bodily damage resulting from misuse of products or supplier modifications. Liability is limited to the order amount and excludes indirect damages (loss of profit, turnover, etc.).
Most products benefit from legal guarantees and manufacturer warranties. Any defective product must be returned with the invoice, warranty, and return form.
The warranty does not cover external causes (accidents, lightning, voltage fluctuations, etc.) or misuse.
Non-compliant products may be replaced or refunded depending on availability.
Excluded from warranty: modified or repaired products by unauthorized persons.
Claims for visible defects must be made within 7 days of delivery.
Article 11: Intellectual Property
All elements of the seller’s website remain its exclusive intellectual property. No one is authorized to reproduce, exploit, redistribute, or use them, even partially, without prior written consent. Any link requires prior written authorization.
Article 12: Personal Data
All personal data necessary for order processing is stored by the seller and may be shared with partners when required. The user authorizes the seller to use this data for statistical and commercial purposes. Data is also retained to facilitate future orders.
The seller undertakes not to disclose this information to third parties. Users may request access to and correction of their data at any time.
Article 13: Proof
The parties accept electronic means of proof (such as email, backups, etc.) in their relationship.
Article 14: Gift Card Terms of Use
Article 15: Dispute Resolution
These online sales conditions are governed by Belgian law. In case of dispute, the courts of the seller’s registered office shall have jurisdiction, except where mandatory legal provisions apply.
